Overview
The Council is responsible for issuing premises licences under the Gambling Act 2005.
In the case of an application for a new premises licence, a provisional statement, or to vary, transfer or reinstate a premises licence the applicant is required to give notice of the application as follows:
- By sending a notice of application, in the prescribed form to all of the responsible authorities within 7 days beginning on the date on which the application is made. In the case of applications to transfer or reinstate a premises licence notice need only be sent to the Licensing Authority, the Gambling Commission, the Police, the Safeguarding Children's Board and H.M. Revenue and Customs.
- By displaying a notice, in the prescribed form, on the premises to which the application relates in a place where it can conveniently be read by members of the public from the exterior of the premises for a period of no less than 28 consecutive days starting on the day after the day on which the application was given to the licensing authority. In the case of an application for a provisional statement in respect of premises that are not yet constructed, or that the applicant does not have the right to occupy, on the date on which the application is made, the notice must be displayed as near as reasonably practicable to the premises or proposed premises.
- By publishing a notice of the application, in the prescribed form, in a local newspaper or, if there is none, in a local newsletter, circular or similar document, circulating in the vicinity of the premises. The notice must be published on at least one occasion during the period of ten working days starting on the day after the day on which the application is made to the licensing authority.
Notices must be in the form and manner prescribed by the Gambling Act 2005 (Premises Licences and Provisional Statements) Regulations 2007.
The Licensing Authority may not grant the application until proper notice has been published and until 28 day objection period has elapsed and if it purports to do so any licence issued by the authority shall have no effect.
How to apply for a licence
- Complete the application form. Please note applicants for premises licences must hold or have applied for the appropriate operators licence with the Gambling Commission.
- Enclose a plan of the premises.
- Enclose the fee. Cheques should be made payable to South Tyneside Council.
- Submit the complete application to the Licensing Authority.
- Send the prescribed notice to responsible authorities - new premises (form a) at the same time, to each of the responsible authorities. If there is more than one applicant use form B. See notices to responsible authorities.
- Arrange publication of the prescribed Notice of application for a Premises Licence under the Gambling Act 2005 in a local newspaper circulating in the vicinity of the premises and prominently display the same notice of the application at or on the premises.
Applicants must make sure that the notices referred to in points 5 and 6 are the correct ones and are correctly displayed. Failure to do so will invalidate the application.

Plan to submit with your application
The plan must show:
All premises
- The extent of the boundary or perimeter of the premises
- Where the premises include, or consist of, one or more buildings, the location of any external or internal walls of each such building
- Where the premises form part of a building, the location of any external or internal walls of the building which are included in the premises
- Where the premises are a vessel or part of a vessel, the location of any part of the sides of the vessel, and of any internal walls of the vessel, which are included in the premises
- The location of each point of entry to and exit from the premises, including in each case a description of the place from which entry is made or to which the exit leads

Where the application is for a bingo premises licence in respect of premises to which young children or young persons will be permitted to have access:
- The location and extent of any part of the premises which will be used to provide facilities for gaming in reliance of the licence (other than those parts which include Category B or C gaming machines)
- The location and extent of any part of the premises in which Category B or C gaming machines will be made available for use in reliance on the licence
- The nature and location of any barrier or other thing separating any part of the premises in which Category B or C gaming machines will be made available for use from any other part of the premises
Adult gaming centre
Where the application is for an adult gaming centre premises licence:
- The location and extent of any part of the premises in which gaming machines will be made available for use in reliance on the licence
Family entertainment centre
Where the application is for a family entertainment centre premises licence:
- The location and extent of any part of the premises in which Category C gaming machines will be made available for use in reliance on the licence
- The location and extent of any part of the premises in which Category D gaming machines will be made available for use in reliance on the licence
- The nature and location of any barrier or other thing separating any part of the premises in which Category C gaming machines will be made available for use from any other part of the premises
Betting premises
Where the application is for a betting premises licence, other than in respect of a track:
- The location and extent of any part of the premises which will be used to provide facilities for gambling in reliance on the licence
Betting tracks
Where the application is for a betting premises licence in respect of a track:
- The location and extent of any part of the premises which is five times rule betting area
- The location and extent of any other parts of the premises which will be used for providing facilities for betting in reliance on the licence
- The location and extent of any part of the premises in which Category B or C gaming machines will be made available for use in reliance on the licence
- The nature and location of any barrier or other thing separating any part of the premises in which Category B or C gaming machines will be made available for use from any other part of the premises
